Registration steps
Search USPTO’s TESS database at tmsearch.uspto.gov.
Also search state databases, business registries, and domain names.
Select ‘Use in Commerce’ (1a) or ‘Intent to Use’ (1b). Foreign applicants may use Section 44 or 66.
Intent-to-Use adds time and cost. File under 1(a) if possible.
TEAS Plus ($250/class) uses pre-approved descriptions; TEAS Standard ($350/class) allows custom ones.
TEAS Plus is cheaper but stricter. If your description fits the ID Manual, choose it.
Examining attorney reviews 3–4 months after filing for conflicts, descriptiveness, and compliance.
Most common refusal: likelihood of confusion (§2d).
3 months to respond (extendable to 6 for a fee).
Call the examiner — they often give helpful guidance over the phone.
Published for 30 days. Any damaged party can file opposition.
Oppositions are rare (<3%). Consider coexistence agreements if contacted.
For 1(a): registration ~11 weeks after publication. For 1(b): file Statement of Use first.
File Section 8 Declaration between years 5–6, renew every 10 years.
